The common scenario in Kenya is that where an arrest is always like a Tom and Jerry game with harassment from the police being the tom. It is however legally important to note that each and every person has a right to remain silent. A research shows that the more silent you are during the process of arrest, the higher your chances of surviving a conviction by the courts.
With the inexperience of the police in Kenya, it is obvious that they shall harass a suspect and consequently violate the suspects Constitutional rights as stipulated under Article 49 of the constitution.
The violation of a right is a chance of a total acquittal and therefore, as a suspect, i will always smile when a police officer slaps me when arresting me, because i know he/she has just saved me a lot.
